Principles of Criminal Defense (ADJ 26)

Course Description:
An examination of the concepts through which responsibility and culpability are applied to criminal law through case law and codification of legal principles.  Criminal court procedures, including the historical development of the justice system, trial proceedings, motions and pleas, jury selection and introduction of evidence will be addressed.

Student Learning Outcomes:
The student will learn procedural aspects of the criminal justice system, including the adversarial nature of our criminal court system and understand its role in criminal defense through evaluation of constitutional and case law.  The student will also understand how the duties of law enforcement, the court system and the correctional system function within the criminal justice system by following the process of arrest through conviction and sentencing within this system.    

The course content will progress on a weekly basis (approximately) through the following topics:

  • Historical Development of Law and the Justice System
  • Search and Seizure
  • Arrest and Custody
  • Initial Appearance
  • Pretrial Proceedings
  • Place and Time of Trial
  • Trial
  • Confrontation and Assistance of Counsel
  • Pretrial Motions, Hearings, and Plea Negotiations
  • Courtroom Evidence
  • Trial: Roles of Major Participants
  • Jury
  • Trial Procedure
  • Instructions and Deliberation of the Jury
  • The Verdict and Appeals
  • Sentencing
  • Collateral Proceedings
  • Victim’s Rights

Required Text:
“Procedures in the Justice System”, Ninth Edition, by Cliff Roberson, Harvey Wallace, and Gilbert Stuckey.  ISBN: 13: 978-0-13-515442-7.  This textbook is available at the COS bookstore or at various online outlets.  One copy of the text will be on reserve at the Weed campus library.
